SIA “VESTABALT” (hereinafter referred to as VESTABALT) is a company that provides services related to transactions with real estate:
- Intermediary services in purchase of real estate, sale, lease, rent;
- Real estate valuation;
- Letting and renting real estate on behalf and in the name of its clients;
- Project management and real estate development.
In cases where you use our services or want to become an employee or partner of VESTABALT, VESTABALT may need to process your personal data. In this case, VESTABALT acts as a processor.
VESTABALT may receive data both from you, when you provide such data, and get it from other sources, for example from an advertisement portal or government databases.
These rules are compiled so that in accordance with regulation of the European Parliament and the Council 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC C (hereinafter Regulation), to provide you, as a subject of data, the necessary information.

(I) When and in what cases we process your personal data
Depending on your use of services, we process your data for one or more purposes that do not require your consent:
- to execute an agreement, for example, to secure conclusion of a transaction related to real estate, execution of transactions and control over execution of transactions;
- to provide evidence of facts relating to transactions in cases of disputes, claims, complaints or court proceedings;
- to fulfil obligations under the law, for example, to comply with obligations under the law with respect to identification in order to prevent laundering of illegally acquired funds;
- to fulfill obligations under the law, for example, for provision of accounting records;
- to ensure protection of our legitimate interests and legitimate interests of third parties, for example, in obtaining necessary legal or advisory assistance, fulfilling obligations of information provided by law, etc.;
- to assess eligibility of applicants for work in VESTABALT and establish employment relations, to implement employment contract;
- to execute request of a court enforcement agent or insolvency administrator to make evaluation of the real estate;
- to perform valuation of a real estate in case of alienation for public needs;
- to respond to legitimate requests from state and local authorities;
- to perform other obligations established by law.
In cases where processing of personal data is necessary for preparation of conclusion of a contract, you are not obliged to provide information. However, please note, that in this case we will not be able to prepare and conclude the contract.
If we require to provide information to identify you as a client to comply with the relevant requirements of prevention of legalization of criminally acquired funds, but you refuse to provide the requested information, we may refuse to work with you.
Only with your consent can we process your data for purposes that have no other legal basis and only to the extent that you have agreed. Such purposes may be, for example, sending a real estate offer or sending a job offer if you are an applicant.
We always process data in a minimal volume in order to achieve data processing purposes. We do not collect or process data that is not necessary for achievement of our goal. By providing us data on your own initiative, we advise you to thoroughly evaluate the volume of data provided. Do not provide us third party data if you are not sure that you have rights to process third party data.

Depending on services used and terms of transaction, the volume of data processed may vary. The volume of data processed is always determined according to each case individually.
(II) If you represent a legal entity that receives services from us
In order to receive services from VESTABALT you provide information about your representative as well as contact persons. Before disclosing information about your representatives and contact persons, please inform these persons about the fact of processing of personal data and possibility to find here information on how such processing of personal data is carried out.
The data of legal entity officials and other representatives will be used to ensure conclusion of a planned contract with a legal entity, execution of such a contract or communication with a legal entity (see section “Why and in what cases we process your personal data “). We process the data of representatives of legal entities and contact persons in order to acquire a proof of preparation, conclusion or execution of the transaction.
If you provide us information about your officials and other representatives, please avoid submission of personal information and personal means of communication (personal phone number, personal email address, home address). Please note that we cannot distinguish information about personal means of communications from the company communication facilities.
(III) If you would like to view a property offered by VESTABALT
If you are a person who wants to view any of the properties offered by VESTABALT for sale, lease or rent, VESTABALT will ask you to provide information about your name, surname and at least contact information and will be a processor of your personal data for the following purposes:
- to answer your questions or inquiries, for example, to arrange viewing of the real estate;
- to execute a contract with the property owner – to prove the fact of viewing of real estate, and if you will be the person who concludes a deal with the owners – to prove that you have invited VESTABALT as a business parter.
Your personal data for execution of agreement will be processed on the basis of our legitimate interests and our legitimate interest is – to prove to the owner of real estate the fact that we fulfill our obligations under the contract of intermediary services. If you do not provide this information, we will not be able to prove that the viewing had taken place, nor can we prove that we have shown you the real estate.
Your data will be saved till the moment when VESTABALT does not need to prove fulfilment of its obligations anymore.
Only with your consent we will process your personal data in order to send you information about similar property offers by email or contact you by phone to offer the next viewing of real estate.
(IV) If you are a job applicant
If you are a job applicant and would like to apply for a job in VESTABALT according to the published by VESTABALT advertisement, we will ask you to send us an application (motivation letter), as well as a description of work experience and education (CV) and contact information, in order to evaluate your compliance to a job position in VESTABALT. In some cases, we may ask you to specify persons who may give you recommendations.
If you do not provide information about your work experience or education and other skills that may be useful for your work, we may have limited opportunities to evaluate you, so we will most likely not evaluate your candidacy. If you do not provide your contact information (e-mail address or phone number), we will not be able to contact you.
Information you provide us will be used in the process of staff selection in order to contact you, negotiate or prepare an employment contract if your candidacy is appropriate and you agree to work in VESTABALT.
If the employment contract with you is not concluded, personal data that you have provided will be kept until completion of search process of an employee for a particular job position.
You can always send us your motivation letter and CV and ask that we contact you in cases when VESTABALT have job vacancies that correspond to the position you are looking for. In such cases VESTABALT will keep your data until your consent is revoked.
(V) If you have granted your consent to processing of personal data
Each time you may agree to receive non-binding information, various offers or promotional materials from VESTABALT for participation in promotions, surveys or public events of VESTABALT.
In this case your personal data will be processed on the basis of consent and your consent and submission of personal data is voluntary. If you do not provide them, we will not contact you, including providing information about VESTABALT offers and will not share any other information unless there are other legal grounds for doing so.
Your consent may be withdrawn at any time, but this will not affect legality of processing of personal data done prior to such withdrawal of consent and legality of such processing.
If you provide consent as stated above, your personal data will be kept until you withdraw your consent.

(VI) Who will receive your personal data
Your personal data will be used only for the intended purposes of data processing.
For data processing purposes, your data may be transferred to VESTABALT real estate agents and service providers serving VESTABALT or may be involved in execution of contractual obligations such as lawyers, sworn attorneys, notaries, accountants, IT professionals, credit institutions, postal service providers, as well as other individuals who are involved in achieving the goal of data processing.
If VESTABALT processes your data while executing powers granted by a third party under power of attorney, your data may be transferred to authority issuing power of attorney (for example tenant of the property, landlord).
In cases determined by law, your personal data will be transferred to the State or local authorities or to the court.
(VII) How long your data will be stored
The time of storage of your data depends on the purpose of data processing, aim and legal basis.
Personal data will only be processed for as long as necessary. The time of storage may be justified by the contract with you, purposes of court proceedings, legitimate interests of VESTABALT or third parties, applicable laws and regulations (for example the law on accounting, regulations on prevention of money laundering, statute of limitations, civil rights, etc.)

We inform you that according to Regulation you have the following general rights:
- to request access to your data;
- the right to request data correction or deletion in certain cases;
- the right to request limitation of processing of your data in certain cases ;
- the right to object to processing of your data in certain cases;
- the right to data transfer;
- the right to withdraw your consent if the basis for processing of your data is your consent;
- the right to file a complaint with the supervisory authority.
